Unparalleled Experience In Admiralty And Maritime Injury Law

When passengers get hurt on a liner’s private island

Cruise lines often advertise visits to their private islands as a highlight of the vacation experience. These destinations offer pristine beaches, exclusive amenities and a controlled environment designed for passenger enjoyment. However, accidents can still happen in these slices of paradise, and when passengers are injured on a cruise line’s private island, a victim’s legal and logistical considerations can be complex.

Private islands owned or operated by cruise lines are considered extensions of their services. This means that a cruise line has a duty to provide a safe environment for passengers while they are on their island, similar to their obligations aboard the ship. This duty includes:

  • Maintaining safe conditions on beaches, walking paths and other public areas
  • Properly inspecting and maintaining recreational equipment, such as kayaks, jet skis or snorkeling gear
  • Providing adequate signage to warn of hazards, such as strong currents or uneven terrain
  • Ensuring that staff are trained and capable of responding to emergencies, including medical incidents

When a passenger is injured due to a cruise line’s failure to meet these responsibilities, the company may be held liable.

Taking action

Filing a claim for an injury on a private island is more complicated than a typical civil case. Cruise lines often include limitations and waivers in their passenger contracts, restricting the time and location for filing a lawsuit. For example, claims may need to be filed in a specific jurisdiction, regardless of where an injury occurred. Additionally, meeting legal requirements for damages can be difficult without proper documentation of the conditions that caused an injury.

These are just some of the reasons why cruise passengers who are injured on a liner’s private island should strongly consider seeking legal guidance and support.
